Preliminary provisions

  1. Wiki Songbook, hereinafter referred to as the "Website", allows for the publication of musical arrangements for educational purposes. Arrangements are available via the website or a mobile app available for Android and Apple devices.
  2. The publisher of the Website is Lune Spółka z o. o. with its registered office at ul. Jana Długosza 3/B, 51-162 Wrocław (hereinafter referred to as the "Publisher")
  3. Both individuals and legal entities, can register on the Website. In these Terms and Conditions, the term "User" refers to a person registered on the Website and using its resources.
  4. “Recording” means any audio-video files uploaded by a user to the website, including: song performances, tutorials, interpretations, promotional videos, presentations, audio-visual fragments, etc.
  5. The website and mobile applications are intended for users aged 12+. The website and applications may contain content that is inappropriate for younger users.
  6. By opening an account on the Website, the User undertakes to use the account in accordance with applicable law, social and moral norms and the provisions of these Regulations.

Publication of video recordings

  1. Users may submit Recordings using the features available in the Songbook application. Submitting a Recording constitutes acceptance of these terms and conditions and granting the license described below.
  2. The User grants the Publisher a non-exclusive, royalty-free, worldwide, sub-licensable and perpetual license to use, copy, reproduce, display, modify, adapt, publish, distribute and sub-license the submitted Recording, including in part or in whole, for service, marketing, promotional and analytics purposes.
  3. The User represents and warrants that:
  4. Owns all copyrights, related rights, image rights, performance rights and other intellectual property rights relating to the recorded material (and the materials used in the background),
  5. The recording does not infringe the rights of third parties, including copyright, image, privacy, confidentiality of correspondence or any other legal rights,
  6. The recording does not contain any content that is illegal, offensive, pornographic, infringes personal rights or promotes hatred, violence, discrimination, extremism, self-harm, drugs, etc.,
  7. Has the consent of all third parties present in the Recordings (e.g. background guests).
  8. In the event of a breach of these representations, the User undertakes to indemnify the Publisher from liability, cover all costs of legal proceedings, damages and other claims related to the infringement of third party rights (indemnification).
  9. You may not submit Recordings that contain:
  10. Content that infringes copyright, license or related rights,
  11. Protected material without an appropriate license,
  12. Trademarks, advertisements or promotions without the owners' consent,
  13. Pornographic, extremist, inciting violence or hatred, discriminatory, self-harming, violating personal rights or children's rights,
  14. Materials containing confidential information, personal data, or correspondence without consent.
  15. Requirements for published Recordings:
  16. The performer must be visible in the recording,
  17. The recording cannot have the original performance as background music.
  18. The publisher reserves the right to:
  19. deletion of part or all of the Recording without giving a reason,
  20. blocking the user account in the event of repeated or gross violations,
  21. delete the Recording after receiving a valid request.
  22. In the event of third party claims in connection with the Recording, the User shall cover all costs of court proceedings, legal representation and awarded damages.
  23. In the event of the discontinuation of the website or the Publisher resigning from further use of the Recordings, the license shall remain effective for existing materials, with the right to further use them for archival, educational and promotional purposes.

Limitations of liability

  1. The editorial office is not responsible for:
  2. infringement of copyright by Website Users who publish, in whole or in part, literary works, photographs or other materials without acknowledging or properly attributing personal copyrights;
  3. infringement of copyright or other rights by Users of the website or third parties, in particular for unauthorized use of the work by other persons or its publication in any form;
  4. any property damage suffered by the User as a result of participation in the website;
  5. consequences of improper use of the Website by its Users, in particular in a manner inconsistent with the law and the provisions of these Regulations;
  6. content and opinions posted on the website by community users (comments, forum messages, private messages and others);
  7. damage resulting from third parties obtaining the access password to the website;
  8. use of materials posted on the website by third parties.
  9. damage resulting from the use, reproduction or suspension of publication of the Recording,
  10. third party claims regarding copyright, image or personal rights,
  11. content posted in Recordings by users or third parties,
  12. breach of obligations by the user, even if they result from inexperience or carelessness.
  13. the publisher is not liable for any direct, indirect, incidental or special losses in connection with the Recordings.
  14. In the event of any claims by third parties arising from the infringement of their rights by the User's publication of materials on the Website, the User undertakes to assume the entire costs of any court proceedings, costs of legal representation and any damages awarded or determined through a settlement.
  15. The editorial office reserves the right to:
  16. changes, corrections or editing of information entered by the User;
  17. periodic shutdown of the Website;
  18. Closing the Website, after prior notice to Users on the website. In the event of closure, all User data and works will be permanently deleted.
  19. These Terms and Conditions will be made available to all Users on the website. The Editorial Office reserves the right to amend these Terms and Conditions after publishing them on the website.
  20. In matters not regulated by these regulations, the principles of Polish law and broadly understood Netiquette shall apply .

Online payments

  1. The Publisher offers the opportunity to support the development of the Website by purchasing Subscriptions , one-time Donations , and other promotional products. Payments are processed via the Stripe platform, and the provider enabling payments from Polish bank accounts is the Przelewy24.pl platform.
  2. By placing an order in the store in any form, the ordering party declares that he or she agrees to the terms and conditions set out in these regulations.
  3. Payment providers may collect and process necessary personal data to provide payment services. Details are available in the Stripe privacy policy and the Przelewy24.pl privacy policy.
  4. Users of the Songbook app can also purchase a subscription directly within the app. In this case, payment is handled by the platform provider—Apple or Google.

Unsubscribe

  1. You can cancel your subscription purchased via the website at any time on the subscription management page .

Complaints and returns

  1. Users may file a complaint or cancel their purchase of a Grant or Subscription and request a refund. Complaints or refund requests can be submitted via the contact form or by sending an email to payments@wikisongbook.com within 14 days of purchase.
  2. When submitting a complaint, please provide the account ID, payment ID or email address associated with the account from which the purchase was made.
  3. The Publisher will review the complaint within 7 days. In the case of a request to cancel a Subscription or Donation, no further explanation is required.
  4. The refund will be made using the same method used to make the payment within 7 days of the complaint being considered.
